These Organiser Terms and Conditions ("Organiser Terms") apply to any individual, business, or entity ("Organiser", "you") that lists, promotes, or sells tickets to an event through https://booktkit.com, operated by SourceCatch Konnect Pvt. Ltd. ("Booktkit", "we", "us"). By creating an Organiser account or listing an event, you agree to these Organiser Terms in addition to our general Terms and Conditions.
1. Eligibility and Account
- You must provide accurate business/individual details, including a valid contact email and phone number, during onboarding.
- You are responsible for the accuracy of all information submitted about your event, including dates, venue, pricing, and terms.
- You must have the legal right to organise and host the event listed, and to sell tickets for it.
2. Event Listings
As an Organiser, you agree that:
- Event descriptions, images, pricing, and ticket categories must be accurate and not misleading.
- Any specific cancellation, refund, or exchange terms for your event must be clearly disclosed at the time of listing.
- You will comply with all applicable laws, licenses, permits, and safety regulations required to host the event.
- You will not list prohibited, illegal, or infringing content or events on the Platform.
3. Ticket Sales and Payments
- Booktkit facilitates ticket sales on your behalf through the Platform and its payment gateway partners.
- Applicable platform/convenience fees and payment gateway charges will be disclosed to you prior to listing and may be deducted from settlement amounts.
- Payouts to Organisers are made to the bank account/payment details provided during onboarding, subject to standard settlement timelines and any applicable holds for verification, disputes, or fraud checks.
4. Cancellations, Postponements, and Refunds
- If you cancel or postpone an event, you must notify Booktkit immediately so Users can be informed in accordance with our Event Cancellation/Postponement Policy.
- You are responsible for defining and honouring refund terms for your event, consistent with applicable consumer protection laws.
- Where an event is cancelled, you are responsible for ensuring sufficient funds are available for User refunds, and Booktkit may withhold or reclaim settlement amounts to facilitate such refunds.
5. Prohibited Conduct
You agree not to:
- List fraudulent, fake, or non-existent events.
- Circumvent the Platform to solicit direct payments from Users for a listed event without authorisation.
- Misrepresent event details, capacity, or ticket availability.
- Engage in any activity that violates applicable law or infringes third-party rights.
6. Customer Support and Communication
Organisers are expected to reasonably assist in resolving User queries related to their events, including entry issues, event changes, and refund requests, working alongside Booktkit's support team where needed.
7. Suspension and Termination
Booktkit reserves the right to suspend or remove an event listing, withhold settlement, or terminate an Organiser account in cases of suspected fraud, repeated User complaints, violation of these Organiser Terms, or non-compliance with applicable law.
8. Indemnity
You agree to indemnify and hold harmless Booktkit and its affiliates from any claims, losses, damages, or liabilities arising from your event, your conduct as an Organiser, or your breach of these Organiser Terms.
9. Limitation of Liability
Booktkit's role is limited to providing a ticketing and payment facilitation platform. Booktkit is not liable for the conduct, performance, or delivery of your event, and Organisers bear full responsibility for their events.
10. Changes to These Terms
We may revise these Organiser Terms from time to time. Continued use of the Organiser features of the Platform constitutes acceptance of the revised terms.
11. Governing Law
These Organiser Terms are governed by the laws of India, with exclusive jurisdiction in the courts of India.
